Florida Law on Drug Possession with Intent to Sell

Florida Statute 893.13(a) states that “it is unlawful for any person to sell, manufacture, or deliver, or possess with intent to sell, manufacture, or deliver, a controlled substance.” Florida’s Controlled Substances Act contains a list of substances grouped into five (5) different “Schedules” or classifications. The degree of the crime and the potential penalties for Possession with Intent to Sell differ based on which schedule of drug was possessed. • A conviction for possession with intent to sell a substance in Schedule V can result in a misdemeanor of the first degree, which is punishable by a jail sentence up to one year and/or a fine not more than $1,000.
