Possession of Cocaine

If you have been arrested in Brevard County / Central Florida for possession of cocaine, you need an experienced criminal defense attorney at the earliest possible stage in your case.

As with any felony drug charge, possession of cocaine carries with it harsh potential penalties including incarceration, long probation terms, and heavy fines. The Canina Law Firm have well over 60 years of combined experience defending against cocaine possession and related drug offenses. 100% of our practice is devoted to criminal defense.

Florida Law

In the State of Florida, it is against the law to be in actual or constructive possession of ANY amount of cocaine. Possession of under 28 grams of cocaine is a third degree felony in the state of Florida, which is punishable by up to 5 years in prison, 5 years probation, and/or a $5000 fine.

Collateral Consequences

If convicted of a felony, a person loses their civil rights including their right to vote in any local, state, or national election, their right to bear arms, and their right to serve on a jury. Current and future job opportunities will be compromised. In addition, if convicted for possession of cocaine, the Florida Department of Highway Safety and Motor Vehicles will suspend the person’s driving privileges for 1 year. On the 1 year suspension, the person will be ineligible for a hardship license for the first 6 months. Also, if placed on probation, standard terms and conditions may include a substance abuse evaluation, drug counseling, random urine screening at the offenders expense, and more.

How to Avoid a Conviction for Possession of Cocaine

It is important to note that simply being charged with possession of cocaine does not necessarily mean you will be convicted. Depending on the facts of your case, there may be several other ways to resolve your case without a conviction including placement in a pretrial diversion program, a pretrial intervention program, or a drug court program, by successfully arguing a motion to suppress evidence, or by obtaining a withholding of adjudication.
