Possession of Drug Paraphernalia Attorneys in Melbourne, FL

If you have been arrested in Brevard County for possession of drug paraphernalia, you should retain an experienced criminal defense attorney at the earliest possible stage of your case.

The attorneys at The Canina Law Firm have well over three decades of combined experience defending against all types of drug related charges.

Florida Law

Under Florida Statute 893.147, it is unlawful for any person to use, or possess with intent to use durg paraphernalia: (1) to plant, propagate, cultivate, grow, harvest, manufacture, compound, convert, produce, process, prepare, test, analyze, pack, repack, store, contain, or conceal a controlled substance; OR (2) to inject, inject, inhale, or otherwise introduce into the human body a controlled substance in violation of chapter 893.

Possession of drug paraphernalia is a first degree misdemeanor in the State of Florida and is punishable by up to 1 year in the county jail, 1 year of probation, and/or a $1000 fine.

Collateral Consequences of a Conviction

In addition to the above, and if you are placed on probation, your probation terms may include fines, mandatory drug testing, attendance at counseling or 12 step programs, and a substance abuse evaluation. Also, having a misdemeanor drug conviction may result in a loss of current employment and future employment opportunities as well as academic opportunities.

Possible Ways to Avoid a Paraphernalia Conviction

It is important to note that simply being charged with possession of paraphernalia does not necessarily mean you will be convicted. There may be several other ways to resolve your case without a conviction including placement in a pretrial diversion program, successfully arguing a motion to suppress evidence, or by obtaining a withholding of adjudication.
